Article 1 - Organiser / Organising company

The company Den Berk Délice BV (hereafter ‘Organising Company’) with its registered office at Putten 19-21, 2320 Hoogstraten (CBE: 0759.857.121) is organising a competition called ‘Taste The Season’ (hereafter ‘Competition’) via the website www.promo-missperfect.com (hereafter ‘Website’). The Contest will take place between 01/03/2026, 00h01 until 30/04/2026 23h59.During this period, a winning campaign will be launched in accordance with current contest rules (hereinafter ‘Rules’). The Competition and any promotion related to the Competition are neither managed nor supported by Facebook. Consequently, the Organising Company exempts Facebook from any responsibility concerning all elements related to the Competition, its organisation and promotion.
The Competition takes place in Belgium.
 

Article 2 – Conditions of participation

In order to participate in the Competition (and be qualified as ‘Participant’ hereafter), the candidate must comply with the conditions set out in this article.

The Contest is open to any natural person over the age of 18 on the Contest start date. Winners who are not domiciled in Belgium or Netherlands must provide a specific address in Belgium or Netherlands. They must have their own internet connection and email address. Under no circumstances may a participant play under multiple pseudonyms and/or multiple addresses and/or on behalf of other participants and/or by any other means that allows him to fraudulently multiply his participation.

Excluded from participation are: 

Persons who do not meet the above requirements; 

• Personnel of the organising company and personnel of partner companies who have participated directly or indirectly in the organisation and promotion of the game, as well as their family members (direct blood relatives in the ascending and descending lines, as well as spouses and partners) 

• The Organising Company will automatically exclude from the game all participants who have used scripts, software, robots or other techniques that allow automatic participation without physical intervention.

• The Organising Company reserves the right to prosecute anyone who has committed fraud or attempted fraud during this competition.

• The Organising Company reserves the right, against any person who disrupts the conduct of the operation and endangers the administration, security, fairness, integrity or smooth running of the competition, to temporarily or permanently, in whole or in part, block the opportunity to participate in the competition, not award any prizes won to such person and reserves the right to take legal action against him, if applicable.

• The Organising Company will make every effort to ensure equal opportunities for all participants. For this purpose, participants consent to any verification regarding their identity and contact details. Any incorrect or untrue information will automatically result in exclusion from participation.

Article 3 - Supporting the action

The competition will be announced via:

• Digital campaign on social networks in Belgium (Facebook, Instagram, Tiktok)

• Influencer campaign on social networks in Belgium.

• Shelf communication using wobblers in Belgium.

• On the packaging of Miss Perfect Délice - Sweet Cherry 300 grams

• On the packaging of Miss Perfect Délice - Sweet Color Mix 200 grams and 240 grams.

Article 4 – Principle and conduct of the Competition - Conditions of participation

The Competition will be announced by the Organising Company on the packaging of Miss Perfect Délice - Sweet Cherry tomatoes and Miss Perfect Délice - Sweet Color Mix, on the Instagram page ‘@missperfect_tomatoes’.

Participation in the Competition is solely and directly through the Website.

 

To participate in the Competition, the Participant must carefully follow these steps:

1. Purchase Miss Perfect Délice Sweet Cherry or Sweet Colour Mix from one of the Belgian supermarkets (Delhaize, Carrefour, OKay, Spar or Jumbo).
2. Follow the Instagram page @missperfect_tomatoes on Instagram.
3. Go to the website and fill in the form. Answer the question ‘In which year was “The Original Kamado” created?’. And answer the tiebreaker question: ‘How many consumers will participate in the promotion between 1 March 2026 and 30 April 2026?’
4. Provide your personal details. Participants must identify themselves with their full and correct personal details: surname*, first name*, date of birth*, email address*, postcode*. Participants must also tick the box for the use of their personal data. Registrations with an invalid or temporary email address or with incorrect details will not be processed.  
6. The winners of the competition will be contacted via the email address they provided.

7. It is not possible to participate in this competition in any other way than described in these rules. Participation by post will not be accepted. No telephone enquiries will be answered regarding the conditions of the competition or the interpretation of these rules. All costs associated with participating in this competition (telephone, computer, internet costs, etc.) are entirely at the expense of the participants. Under no circumstances may they demand that the Organising Company cover these costs. The Organising Company reserves the right to request clarification or to cancel any participation(s) that appear to be in violation of the rules set out in these rules. Participants authorise the Organising Company to carry out all checks relating to their identity and address. The winners will be determined in accordance with the rules laid down in Article 6 of these rules. ​

Article 5 - Competition prizes

During the Competition, four Big Green Egg BBQ Mediums will be given away. Only one prize will be awarded per physical person (same first name, same surname, same email address). We will raffle off one prize each at the following retailers: Delhaize, Carrefour, Okay and Spar.

The Big Green Egg BBQs will be presented on Saturday 13 June during a workshop event organised by Big Green Egg.

Article 6– Designation of the winners

The number of winners of the Competition is limited.

In Belgium, four people will have the chance to win a Big Green Egg BBQ Medium. Each Big Green Egg is worth €2,500.

Only the winners of the Competition will be notified of their prize by e-mail and/or telephone. If the e-mail address provided by the participant is incorrect and/or does not allow the e-mail sent by the Organising Company to be received for technical reasons and/or if the winner does not respond within the specified period (2 weeks after the e-mail was sent by the Organising Company), he/she will lose his/her right to the prize and will not be able to claim any compensation, in any form whatsoever. The Organising Company reserves the right to ask each winner for proof of his/her identity. Subject to checking the validity of his/her participation and confirmation of his/her details, each winner will receive his/her prize within a period of approximately four weeks after the end of the game. The prize is personal to the winner, cannot be traded and cannot be exchanged for cash.

The prize offered to the winner cannot give rise to any dispute of any kind, nor to the award of financial compensation (in whole or in part), nor to the exchange or replacement by another prize, of any value, for any reason whatsoever.

If circumstances so require (force majeure, events beyond the control of the Organising Company), the Organising Company reserves the right to replace the prize won by another prize of equal value, without this giving rise to any liability.

The prize is awarded in the name of the winner, only once during the duration of the competition and cannot be transferred to third parties.

Article 7 - Awarding of the prize won

The winners declare that the personal data that may be requested are true, correct and correct. The final award of the prize will be announced after this verification, regardless of any prior notifications by e-mail.

If the contact details contain incorrect and/or incomplete and/or false information and/or do not allow the organizing company to contact the winners concerned, the award of the prize will be cancelled.

If the prize cannot be delivered to the winner or if it is returned to the sender, it will be definitively lost.

Winners will be notified by e-mail to the e-mail address they provided when participating in the competition.

If for any reason it is not possible to award the prize, the Organizing Company may re-allocate the prize to another participant in the competition. This participant will be designated on the basis of the criteria set out in article 6.

The Organizing Company cannot replace the original seller of the gifts. The winners therefore undertake not to claim any liability from the Organising Company for the prize, in particular with regard to its condition and quality. Furthermore, the Organising Company accepts no liability for any damage suffered by the winners when using their prize.

Article 8 - Responsibility

The Organising Company declines all liability in the event of a malfunction of the internet lines and/or reception equipment that jeopardises the smooth running of the competition.

The Organising Company reserves the right to shorten, extend, modify (in particular the announced dates) or cancel this competition for any reason whatsoever, without being held liable for this and without the participant being able to claim compensation for any reason whatsoever.

The Organising Company reserves the right to temporarily suspend the possibility of participating in the competition if it (or its potential hosting provider) can no longer guarantee the continuity of the service required for the execution of the competition.

In addition, the Organising Company reserves the right to stop or suspend the competition in the event of fraud or in any case when, for any reason whatsoever, the computer system awards prizes that are not provided for in these regulations. In such cases, the message informing the participant of a win will be considered null and void.

The Company Company declines all responsibility for any incidents and/or accidents that may occur while enjoying the awarded prize and/or as a result of its use and, in general, for any dissatisfaction with the delivery of the prize. (e.g. Bpost)

Article 9 - Force Majeure

The Organizing Company cannot be held liable in any way if the event, for any reason beyond its control, cannot take place according to the planned circumstances (delay/loss during transport, total or partial destruction or for any other reason).

Article 10 - Protection of privacy

In the context of the management of the Contest, the Organizing Company, as data controller, processes the personal data of the Participant in accordance with the applicable legislation (including the General Data Protection Regulation EU/2016/679) and in accordance with the privacy policy, available at https://www.promo-missperfect.com/privacy.
The Participant has been informed that the Organizing Company will process his/her personal data for the management of the Contest.
In the context of the management of the Contest, the following data will be processed: acceptance of the Rules, result of participation in the Contest, date and time of participation, surname, first name and e-mail address.
The Participant agrees that his/her first name and surname may be used in the context of the announcement of the winners on the Facebook page.
The Organizing Company will retain the personal data collected for the period necessary for the management of the Contest and at the latest as described in the Privacy Policy. The Organising Company will not pass on the Participant's personal data to third parties, except where necessary in the context of the Competition or with the prior express consent of the Participant.
The Organising Company will take all necessary precautions to keep the data confidential. However, the Participant acknowledges that sending this data via the internet is never without risk.
The Participant has the right to access the data concerning him/her and may, if necessary, request that they be modified or deleted by contacting the Organising Company in the manner described in the following link: https://www.promo-missperfect.com/privacy.
The Participant also has the right to object to the processing of his/her personal data. His/her participation in the Competition will be cancelled if the Participant has his/her data deleted or if the Participant objects to the processing thereof. In order to exercise the Participant's rights, the Participant must consult the privacy policy available at the following link: https://www.promo-missperfect.com/privacy. The Participant agrees to all checks regarding his/her identity and data. Any indication of a false or incorrect identity or a false or incorrect address will automatically lead to exclusion from participation.
If a Participant has complaints regarding the processing of personal data, he/she is requested to contact the Organizing Company. If no satisfactory solution can be found, the Participant can file a complaint with the Belgian Data Protection Authority.

Article 11 – Communication

All communication about the Competition and the application of the Regulations will only be done by e-mail to the following e-mail address marketing@denberkdelice.be. The Organising Company can never be held responsible for any defects in the IT systems or for the non-functioning or malfunctioning of the server.

Article 12 – Acceptance and application of the Rules

Participation in the Competition implies unconditional acceptance of the Rules. No disputes will be considered.
Complaints regarding the Competition must be sent in writing to the registered office of the Organizing Company within (7) working days of the end of the Competition. Complaints can never be processed orally or by telephone. Complaints that are not submitted on time, are not formulated in writing or whose author cannot be identified by name will not be processed.
These Rules can be consulted at any time on the website https://www.promo-missperfect.com/wedstrijdreglement.
The Competition is supervised by the Organizing Company. In the event of force majeure, unforeseen circumstances or in the event of a dispute, the Organizing Company may take all necessary decisions to ensure the smooth running of the Competition. Its decisions are sovereign and are not subject to appeal. The Organizing Company reserves the right to exclude a Participant – and, if applicable, a winner – in the event of a breach of one or more conditions of participation or in the event of abuse, fraud or treacherous participation in the Competition.
The Organizing Company may exclude Participants if it is established or suspected that they have attempted to harm the legitimate course of the Competition by means of cheating, piracy or other fraudulent, misleading or unfair practices (including generating entries or votes by means of script, macro, robots, programs or other automated means). In such cases, the Organizing Company may also exclude the Participants concerned from participating in future promotions.

There will be no correspondence or telephone communication in relation to this competition, neither before, during or after the competition.

Decisions are final and irrevocable.

Article 13 – Applicable law and disputes

The Participants undertake to first try to find an amicable solution with the Organising Company in the event of complaints regarding the application or interpretation of the Competition before taking any other steps.
If a provision of the Regulations is to be deemed null and void or invalid, the other provisions of the Regulations shall remain valid. The Organising Company shall be entitled to establish one or more replacement provisions that approximate as closely as possible the nature and scope of the null and void or annulled provision without themselves being null and void or voidable.
The Regulations and the course of the Competition itself are subject to Belgian law. In the event of a dispute, the Dutch-speaking courts of Brussels shall have exclusive jurisdiction.
